Establishment And Promotion Of Complaint And Punishment System Against Judges

No definitive rules stipulated under laws and regulations of our country upon the means of complaining against judges for interested persons and others, institutions authorized to accept such complaints and machinery for dealing with the complaints, and that the responses shall be offered or not after receipt of an complaint, how long it shall take to offer the responses, institutions authorized to punish judges, participants and procedure of executing such punishments.What is the matter with the present complaint and punishment system of our country if it does not seem satisfying? What is the present situation about complaint and punishment system in developed countries in this field? Are there any achievements our country can learn? This thesis starts from the significance of establishment and promotion of complaint and punishment system against judges, then states present complaint and punishment system against judges and further analyzes the problems in it. According to the disadvantages and limits of present system which is used to monitor judges, it could be concluded that our complaint and punishment system against judges is not sound or perfect. There are no procedural or timeliness rules upon the complaint and punishment system in China.It is quite necessary to establish and promote complaint and punishment system, which is of important significance as well. In present system there are many disadvantages which cause that the monitor system does not work well and that some fields are not even covered by the system. The present situation of this system not only affects the impressions of judicial institutions but also influence the protection of legal interests of interested persons. How do we set up a sole, justice and high efficient complaint and punishment system? Advice from other may help one overcome one's shortcomings! The experiences of some developed countries in this area could be learned by our country. This thesis states that the establishment of administrative complaint center of Beijing and introduces the systems of complaint and punishment against judges of Canada, based on which, put forward the ideas to set up justice complaint center which is specialized in monitoring judges and further to establish and promote complaint and punishment system against judges.
