The People's Congress's Supervision On The Court

The Constitution and other related laws authorise the People's Congress to supervise the government,the court and the procuratorate.Compared with the other powers of the People's Congress,such as the power of legislation and the power to decide important events,there is still some limitations on its supervision,especially on its judical supervision.Its inaction is one of the main reasons of the current judical corruption,and its ultra vires,such as the supervision of individual case,also cause some adverse influence to the judicial independence.This paper,which is based on both the theories and practice of the judical supervision in China and some other countries,demonstrates the reasonableness of the People's Congress's supervision on the court.By analysing its current existing problems,this paper offers some advices to improve the supervision model.It is trying to not only secure the indenpence of trial,but aiso prevent the judical corruption.The hope is that this study can provide positive recommendations and make the People's Congress's judical supervision more effective.
