Study On Legal Issues Of The Non-Profit Scientific Research Institution In China

The non-profit scientific research institution is an important component of thenational scientific research system. The level of non-profit scientific researchinstitutions'development plays an irreplaceable role in upgrading science andtechnology capability of independent innovation and promoting the nationalinnovation system. A sound legal system of the non-profit scientific researchinstitution is an essential factor to encourage and protect it. But the domestic legalsystem of the non-profit scientific research institution fails to keep pace with theneeds of its development, so it has become a bottleneck restricting its rapiddevelopment and has led to serious negative effects. It has become an urgent need toaddress how to improve the existing legal system of the non-profit scientific researchinstitutionforourcountry.Against the status quo, this thesis studies legal issues of the non-profit scientificresearch institution in China. By applying the studying ideas and methods, absorbingthe results of the reform of scientific research institution for public welfare, andanalyzing the characteristics of legal regulations of the United States and Germanyasrepresentative of foreign countries, this thesis proposes systematic suggestions for thestandardization and protection of the non-profit scientific research institution. Theillustrationsaregenerallydividedintofiveparts:Firstly, the thesis has a brief review of development of domestic and foreignnon-profit scientific research institutions, introduces the status and presents thepractical and theoretical significance of this research. Then, there will be a detailedinterpretation of its evolution and the main problems faced by the institution in ourcountry. The fundamental reason is the deficiency and inadequacy of current LegalRegulation. Further, it explores legislative status and pointing out the main legalissues. The next part extends our view to foreign mature legal regulations byintroducingand studying the specific system in the United States and Germanywhichsupplies a systematic background for the perfection of domestic legal system ofon-profit scientific research institutions. Lastly, based on the above analytical studieson the theoretical and practical experience, the thesis puts forward some suggestions to perfect the present legal system of non-profit scientific research institutions fromlegislativemode,legalsystemoftaxrevenue,boardsystem,administrativesystem.
