Protection Of Trademark In Network

The intellectual property rights issue in network is the main issue of the intellectual property rights nowadays. High speed network information circulation and global information spreading has greatly shocked the presenting system of the intellectual property rights. The network environment caused a series of contradiction conflicts of intellectual trademark rights and new issues. The network information technology not only greatly affects about the performance and development of the network itself but also puts a new challenge and new research questions before the system of intellectual trademark rights. How to establish and perfect the security system of intellectual trademark rights in network and provide a firm harmonious as well as all profits reserved protection developing environment, which is an urgent theoretical issue and also a practical issue.In this paper, the trademark protection in network has been discussed from the network trademark and well-known mark. Two practical approaches are offered then to settle the conflicts: administrative and judicial. In the ending, the problems of well-known mark anti-dilution in network are discussed, an outline of well-known mark anti-dilution on legislation and judicature is put forward.
