On The Reform Of The Legal System Of Letter-complaining In Shenyang City

The letter-complaining system is one of the special systems in China's public life, which originated from ancient China,and currently it has been treated as a legal mechanism.The existence of letter-complaining system is necessary for China,because the legal system is far from perfection,the judicial authority is low and people's legal consciousness is weak.So the mechanism of letter-complaining could be a platform for the government and the people to communicate,and people's fights could be remedied in this process.However,the traditional letter-complaining system has some features of rule of men,not rule of law,so it is urgent to re-construct the letter-complaining mechanism.This dissertation focus the reform of letter-complaining in Shenyang City, Liaoning Province,and researches the reform process in Shenyang with various researching methods.This dissertation composed of three part,they are as below:The first part is the history of letter-complaining system in China and its necessity to reform.In this part,this dissertation analyzes the history of letter-complaining system and talks about why we should reform the letter-complaining system in the background of rule of law.This part maintains that in ancient time the letter-complaining system shows the ruler's sympathy for the people,while in the society of rule of law,it should be reformed.The second part is the history of letter-complaining system in Shenyang and its current situation.In this part,the history of letter-complaining system in Shenyang and its current is introduced.And the achievements of letter-complaining system reform in Shenyang is also talked about,but this dissertation maintains that the letter-complaining system in Shenyang is still has some flaws and need to revised.The third part is how to promote the reform of letter-complaining system in Shenyang.Firstly,this part introduces some foreign legal system and analyzes their experience which could be learn by Shenyang.And then this dissertation researches how to promote the reform of letter-complaining system in Shenyang.This dissertation maintains that some measures should be taken,such as the letter-complaining system should be put into the orbit of rule of law,strengthen the terminating system for the letter-complaining mechanism,establish special system for litigation-related letter complaining,and the liability of letter-complaining system should be taken into consideration.
