Research On Law Problem In Investment Of Patent Right Use

Investment system of company law has loosened.With the rapid development of high-tech industries,investment of patent right has already been in practice.The company law follows this trend and gets rid of or amends many forms of investment restrictions. However,we have no clear information that if the investment of patent right use can be one of the ways to invest,though it has already exist.So,we need to explore the relative problems, and hoping to give some suggestions to departments who needs.Partâ… of this article is a brief introduction of investment of patent right use.After the introduction of the definition of patent right use,it analyses the necessity and practical difficulties.Aiming at the above difficulties,partâ…¡explores the feasibility of investment of patent right use,from two aspects:Determination of the nature of the patent right use and coordination with the company law.The third part focuses on the analysis about how to carry out the investment of patent right use in the existing norms.It includes three sections:the ways of investment,exercising after investment,impact on share right if the value change. Based on above,the last part gives a number of legislative proposals.
