Research About Patent Investment In International Direct Investment

With the improving of the science technology, a new kind of international investment has come-the international investment of patent. Compared with other traditional investment methods, patent is intangible asset. For this reason, patent investment is more complex, more risk and more problems, but on the other hand, patent investment is more profit and means a lot to development of nation. It is more important that research the international investment of patent.In this paper, the present writer has researched the theory and practice of international investment of patent in detail. It is based on previous research highlight and by means of defining, comparing, analyzing, illustrating, quoting and generalizing. This text is divided into five parts mainly:Part one is the concept, characteristics and meaning of patent international investment. The definition of "international" is introduced. Part two introduce the legal sources in a systematic way. It includes domestic and international legal sources. In this part, the writer wants to show the fact that the international investment of patent has become the wave of the future. In part three the writer researches the methods of international investment of patent. At present, it is popular of investing by means of patent ownership rights and patent license. It is admitted to investing by means of patent ownership. But there is more debate about whether patent license can be invested. I assent views of investing by means of patent license and give advice and make suggestions. Part four express the theory of patent international investment. In this part, the writer mainly analyzes the valuation of patent and Patent trend of investment securities. Part five is the introduce law of various countries about patent international investment. It is divided into three phase-the necessity of law about patent investment; the procedure of patent investment; the risk-taking about patent investment. In the last part, the write introduce the policy and problem about patent investment in China and make suggestions on base of various countries experience and our failure.From the angle of both theory and practice, the writer try to make clear or modify some points of views by way of expressing thoughts in this paper on some issues that are the targets of pushing forward theoretical innovation and practice development in the patent international investment and make a contribution to China.
