Salvage at sea is a special legal system in maritime law.However,salvage performed or controlled by the relevant competent authorities of the states is a special and important legal system,the study of which is insufficient.The engagement of the competent authorities makes the legal relationship of salvage at sea more complicated, resulting in the disputes and misunderstandings on the legal status,rights and duties as well as the claim for the payment of salvage.To solve foresaid problems,concerning on some subjects performed or controlled by the competent authorities,the author analyzes related provisions of domestic and foreign laws and the international conventions comparatively.As a result of such comparison,basing on the situations and conditions of China,the author provides pertinent proposals to solve these disputes.The dissertation consists of five chapters.In the first chapter,the legal origin of salvage which is performed or controlled by the relevant competent authorities of the state has been discussed.The rules and regulations of relative laws and conventions have been analyzed.The second and third chapters analyze the legal status,rights and duties of the salvage performed or controlled by the relevant competent authorities.In the fourth chapter,the author focuses on the claim for payment of salvage performed or controlled by the relevant competent authorities of the state,and carefully examines recent issues arising out of China salvage industries.In the last chapter,the author analyzes the problems in China law,and provides pertinent proposals to solve the disputes.
