On National Treatment Obligations Under GATT 1994 Article Ⅲ

To define the contents and scope of the China's obligations of national treatment under GATT Articleâ…¢,this paper attempts to analyze Chinese auto parts import measures to clear the specific provisions of Articleâ…¢.The adjudication of DSB caused great controversy in China,many scholars believe that China's measures did not violate GATT Articleâ…¢and gave a lot of defense.In this paper,by studying the WTO expert group final report and previous WTO cases,we try to give a clear definition of Articleâ…¢,on the basis of which we further found that GATT Articleâ…¢didn't give any mandatory requirements on a member's tax system.So the tariff classification of CKD and SKD,the determination of the Tariff rates as well as the tax system of products on the domestic market,all belong to the scope of a member's domestic law.
