Research On The Law About Pet Animals Welfare

In recent years, with improvement of living standard of our people, the number of pets animals in our country increases rapidly. However, the living conditions of pets animals makes people uneasy. Especially there are so many ill-treatments to pet animals that more and more people are concerned about legal issues of pets animals welfare. According to discussing the probloms about our pets animals welfare in theory and practice and learning foreign-related laws and regulations, this dissetation aims to explore a useful and feasible way for the legislation about our pets animals welfare, to promote the legislation as soon as possible, to improve the living environment of pets animals, to solve the related social controversy and management problems, to accelerate the public health development, and ultimately to achieve harmony between man and pets animals.This dissertation, starting from the meaning of animals welfare and ethical basis, leads to the theme of pet animal welfare, and states the meaning of pets animals welfare. Then it discusses the necessity of the legislation about pet animals welfare in our country from three aspects. Firstly, the status of the pet animals welfare is awful, and here points out the suffering of pets animals such as ill-treatment, brutal transportation, brutal slaughter, and the hurt from law itself. These need related legislation. Secondly, social controversy and management problems caused by the pets animals need to be regulated effectivly by legislation. Thirdly, the development of pets animals bussiness needs to be protected by legislation. In the third part of this dissertation, it points out the problems of existing laws about pets animals, including legislative intent, the basic rules, supervise system, as well as legal liability. And it reveals a full range of the development of pet animals welfare in some cities of our country and actual operation of the relevant regulations, then it analyzes the root causes, in order to provide a direction to solve the problems finally. After that, it makes a brief assessment of the pet animals Welfare Acts of EU countries and draws advanced concepts and more comprehensive laws and regulations. During the analysis about foreign pets animals welfare law, it sums up important revelation for our pet animals welfare legislation to guide the legislation in our country. Finally, it demonstrates the personal opinions on our country's building a pet animals welfare legislation, And it gives constructive ideas about legislative concepts, the principles legislation should follow, basic rules, supervision and management system, and legal liability.
