Study On Legislative Problems Of Animal Welfare

The legislation of animal welfare has been paid attention from the early 19th century. In the following hundreds of years'development and breaking process, more and more scholars joined in the discussion about animal welfare and right, and more and more people began to support the idea of animal welfare, the animal protection legislation and its organization. The animal welfare nowadays has been an international topic. Under the advocating of animal guardians and relative international organizations, many countries have established a set of institutions of law about animal welfare.Due to the limit of economic level and insufficient of the public acceptance extent in China, on the aspect of animal welfare protection, we are still in the preliminary period of theoretical approach and do not have a legislative procedure. The welfare legislation about vagrant animal is more out of reach, and the statement is even not being heard in some areas of China. However, the proposal of vagrant animal welfare is very necessary and significant. As an animal affected by our human beings'behavior, vagrant animals have rights to be brought into the filed of being cared by human morality. The vagrant animal welfare is not to avoid the animals suffering any pains or to make them live a superior life as people do. It is just from the perspective of living rights, demanding that we human beings should not hurt the vagrant animals, should save them and help them as much as we can under the circumstance that our benefits are not harmed.This essay, based on animal welfare, is from the point of vagrant animal, discusses the reasons of vagrant animal existence and living condition, analyzes the necessity of its welfare and explores the base of legislation from the law. Also, it puts forward the suggestions as the establishment of punishment rules against abusing pets, of pet feed permit system, of government subsidy system relating vagrant animal and the vagrant animal protection agencies and so on according to the constitution of vagrant animal welfare legislation. Vagrant animal welfare is a product of animal legislation in an advanced stage, embodying a progressive extent of social civilization of a country. The higher the progressive extent is, the wider the morality care is. Advocating the protection of vagrant animal welfare can not only satisfy natural balance needed for human beings sustainable development, but also can embody the animals'spiritual value to people.
