Content: The "free pedagogical lives" policy is not only the concrete performance of our government's education power which following the Constitutional Law, but also the safeguard of the citizen's being educated right, which guarantees the equal opportunity of people being educated. Therefore, learning the "free pedagogical lives " policy from the point of the Constitutional Law is not only essential but also have a vital practical significance to the construction of the harmonious society.Standing in a historic and dialectical way to make analysis, this article analyses the content, value, system, flaw as well as the consummation measures of the "free pedagogical lives" policy under the vision of the constitutional and administrative law. It uses the positivism research technique, with the hope to make people have a further understanding of the policy, and cause different communities of the society to take it seriously enough. In brief, the "free pedagogical lives" educational policy is worth of the Theoretical realm and the practical realm's research and discussion.The article is divided into three parts: at the beginning of the first part it summarizes the existing questions in our country's educational development, and then to analyze the connotation and the nature of the education right. Secondly, basing on the educational right, the part reveals the hierarchy of the educational right in two domains, which are the national education power and the citizen's rights to be educated. Finally, this part interprets from the human rights and the fair justice to make clear of the policy's Jurisprudence value.The second part mainly summarizes the conjunction of the educational policy and the law of constitution and administration, as well as the nation educational power's implementation and the educational right's safeguarding which it highlighted, conveys some views to the policy of "free pedagogical lives".The third chapter mainly discusses the existing flaw of the "free pedagogical lives" on the foundation of the first two chapters. After summarizing its insufficiency, this part also give target-oriented suggestions and measures on how to perfect it, analyzing the implementation's significance of the "free pedagogical lives" policy.
