With the development of society, the issue of the right to education has been attracting widespread attention. As the country's fundamental law, Constitution is supposed to be the most powerful civil rights protection weapon. Although China's Constitution and other relevant education laws stipulate that the citizens have the educated right, due to the fact that China's research in the theory of the educated right lags behind and the fact that we are in lack of a sound and effective legal protection mechanism, educated right fails to be effectively protected and remedied, and in some cases, some educated rights are even beyond reach The first report of the Party's 17th national congress notes that developing education is the first thing of our social construction aiming at improving the citizen's livelihood. The report says: "Education is the cornerstone of the revitalization of the nation; the fairness of education is an important foundation for social equality", thus providing institutional guarantee for the real realization of citizens' right to educationBasing on China's existing systems and reality, and through the analysis of actual cases of violation, this paper analyzes the basic issues of the right to education deeply. The writer analyzes the causes, gives full play to the proper function of constitutional norms to construct the specific legal system for realizing the right to education of the citizens.This paper is divided into three parts: in the first part, beginning from one typical case of the violation of the educated right, the writer explores some basic theories such as "what is the basic educated right, and notes the importance and urgency of the constitutional protection for the educated right; The second part starts from the basic content of the educated right. It studies some basic theories such as the concept, nature, basic content, the main body and core of educated right and so on. It clarifies some vague perspectives, laying the theoretical foundation for the constitutional protection of the educated right; The third part demonstrates through the analysis of some actual cases the necessity and feasibility of at both theoretical and practical levels the constitutional protection for the educated right; Part IV on the basis of the previous text, with the reality of China's legal system and operation as its context, proposes on how to construct the constitutional protection for the educated right system. That is to say we should establish a standing body—Constitutional Commission, under the National People's Congress and in parallel with the NPC Standing Committee to exercise the system of review of violating the constitute on the educated right.
