On The Rural Women's Land Rights And Interests From The Perspective Of Gender Theory

To farmers, the land is their livelihood foundation so Chinese government all the time takes seriously to protect the farmer's legitimate land rights and interests and has formulated certain laws and regulations to claim that the farmers have the land rights and interests and the male and the female have the equal land rights and interests. However, the fact that the rural women's land rights and interests have seriously been infringed does not favor to protect rural women's legitimate rights and interests, also does not favor to execute the state policy of gender equality.The thesis has, from the perspective of gender theory, analyzed how and why rural women's land rights have been infringed. And then it proposes the countermeasures how to consummate their land rights and interests safeguard.The thesis' body is made of four parts. In the first part, the thesis introduces gender theory's concept, characteristic, significance and its development both in western countries and in China.In the second part the thesis has elaborated the present situation that rural women's land rights and interests have been infringed and its negative effects. Firstly, it has analyzed the violation situation of the unmarried woman, the married woman, the divorced woman and the widow and then pointed their negative effecters: sexual non-equality, hindrance to agricultural economy development, social non-harmony.In the third part the thesis thinks there are three reasons why rural women's land rights have been infringed: one is the history that refers to traditional culture, local rule and rural women themselves; another is economy that refers to the average per person land resources are very few; the last is law that is our country's laws and regulations have many shortages and there are contradiction and conflict between the laws.In the fourth part the thesis has elaborated how to protect rural women's land rights. The measures are to adjust tradition, to control population growth and raise the land-use capability, to perfect the laws and introduce gender theory from western countries.
