The Study On The Safeguarding Land Rights And Interests Of Special Group Of Rural Women Under The New Deal Of Land

Land is the most important property and basic living security for China's rural population.Land rights are one of the most concerned and most realistic interests of Chinese farmers.For rural women whose economic status is relatively weak,the social security function of land is more important.There are gender inequalities in China's land rights and interests,and the loss of rural women's land rights is mainly reflected in the process of marriage flow.In general,there are five types of rural women who marry other villages,women who marry non-agricultural households,women who are divorced,women who are beggars,women who are recruited,and "pure women".Their land rights are easier to be Infringement.The infringed contents include the contractual management right,the land transfer income attached to the contractual management right,the compensation for land acquisition,and the use of the house site.The family of married women and the family of husbands and villages are the main cause of infringement of the rights and interests of rural women.This paper believes that the reasons for the violation of rural women's land rights are multi-faceted.The main reasons are as follows:First,there is a lack of gender in the rural land system arrangement,the common nature of the land's family conceals the individual rights of women;the second is the long-term land policy and women.There is a contradiction between the fluidity of marriage;the third is the influence of traditional social customs and patriarchal family concepts.Based on social security theory,land property rights theory and gender theory,this paper combs the history and current situation of rural women's land rights.Taking Putian City of Fujian Province as a sample area,this paper discusses the status of land rights protection for rural women's special groups after the implementation of the new land policy,analyzes the reasons for infringement of rural women's land rights,and proposes countermeasures for improving rural women's land rights and interests.This paper suggests that in order to further protect the land rights and interests of rural women,we should further standardize the relationship between land and property within the family on the basis of improving the registration of rural land contractual management rights;in the legal policy,we should formulate the standards of "members of rural collective economic organizations" as soon as possible;It is conducive to safeguarding the legal environment of rural women's land rights and interests,promoting gender equality in gender equality;and raising women's awareness of land rights.
