With the development of china's real estate and the deepening of the reform of the housing system,the real estate trade gradually becomes multifarious and active, and commercial apartment consumption becomes more and more important in people's personal consumption.However,the various non-standard phenomenon of merchandise building market in our country damages the right to life and property safety and the right to be fair traded of the consumers.The real estate market disorder has not been fundamentally resolved which has a serious impact on the realization of the basic existence right of the consumers and limits the broad masses of the people to further improve the standard of living.This condition not only violates the existence interests of consumer but also influences the development of the real estate industry and deepening of reform of urban housing system.It is so urgent that we should strengthen the protection of commercial apartment consumer.This dissertation firstly studies the commercial apartment consumer's rights and interests and analyses the connotation and characteristic of commercial apartment consumer's rights and interests.Secondly,through observing some concrete problems about encroaching on consumer's rights and interests in the commercial apartment business,this dissertation analyses the reason of the problem.Consumer's weak person status in the market economy,imperfection of the law and the ineffective supervision and management of real estate market,housing market's own characteristics lead to above problems.Then the article put forward the necessity to the protection of merchandise building consumer rights.The article points out there exist many faults in the protection of consumer rights and interests in real estate transactions,such as the ambiguous subject and the imperfect context of the consumers' right in the law of PRC,and there exist much deteriorate conflict between the Law of the PRC on the Protection of the Rights and Interests of Consumers and the commercial house trade law and rules,and so on.In response to these circumstances,the article finally provides legislation protection,judicial protection,social protection as well as government protection to strengthen the protection of consumer rights,with a view to the establishment of community-wide coverage of the all-round,multi-level,three-dimensional protection system,and reduce the violation of legitimate rights and interests of consumers in the real estate transactions.Even if the developers have the behaviors of violating the legitimate rights and interests of consumers,consumers are able to protect their own legitimate rights and interests according the relevant law,and so as to promote the protection of consumer rights,and to promote the China's real estate and even the entire national economy have a healthy and orderly development.
