The Comparative Study On Domestic Laws On The Promotion Of Foreign Direct Investment Between Thailand And The People's Republic Of China

The purpose of this study is to analyze the domestic law of promotion on foreign direct investment in both of Thailand and the People's Republic of China from the history and current status under the different political systems.After that,notices the effects of the factors that make these laws in both countries have their own unique patterns.At last,makes the comparative law between the important domestic laws of promotion on direct foreign investment in Thailand and the People's Republic of China by using the legal principle of international law.The issues of study as listed below.1.The legal principles of international law on investment that are the basic for every country to enact the domestic promotion law such as the principles of admission of investment,international minimum treatment standard,fair and equitable treatment standard,national treatment standard, non-discrimination standard and reciprocity.Including,the law mechanism that supports foreign investment.2.The history and current status in both of Thailand and China under the different political systems that have effect to the domestic law of promotion on direct foreign investment.3.Using the legal principles of international law analyze the domestic law on promotion of direct foreign investment in both countries to make the comparative law for the benefits,disadvantages and the future direction of laws.The result of this study showed that Thailand and the People's Republic of China have the different concepts for treating foreign investment.Thai domestic laws gave more advantages to Thai nationality investors.But in contrast,the People's Republic of China gave more beneficial rights to foreign investments.According to the domestic laws of promotion on direct foreign investment,both of Thailand and the People's Republic of China have the principle of non-discrimination treatment for every foreign country but this standard does not cover for the different treatment between the domestic and foreign investment.Moreover,most of the investment law and promotion zone in Thailand have the same privileges for Thai nationality and foreign investors,it may not be the attractive point enough for the foreign investor.For the People's Republic of China,because the unique form of political system and zone,the constant battle over the applicable law between the country's central government and the provincial and local governments make it difficult for foreign investors to know exactly what the rules are.
