Since 1970's, the technology of information and Internet has been developing rapidly. The development of science and technology makes it easy to collect and use personal information, and also makes it easy to infract personal information. Thus personal information protection is gradually focused on. Presently many countries have made laws to protect for personal information, but so far our country lacks of associated laws, as a result protection of personal information is poor, so it is urgent for us to make a high-level law of personal information. The author tries to analyze the basic nomology and the main problems of the protection of personal information, and tries to bring forward a legislative draft by comparing to the foreign legislative modes.The paper contains four chapters. In the first chapter begins from two cases, and analyzes significance of personal information protection. In the second chapter, the fundamental theory of personal information and its protection are introduced, including the concept, legal attribute of personal information, its main contents and so on. In the third chapter, we analyze the actuality of the personal information protection in China, and points out its causation. In the fourth chapter, we compare the foreign legislative modes, and research which mode we should adopt, and brings forward the legislative suggestion. The author thinks if we want to strengthen the protection of personal information from the standpoint of administrative law, we should establish the system from two points, which are to regulate administrative organs of information processing effectively and to give full scope to administrative organs' function of supervision and administration. This is the innovation in my thesis.
