The Comparative Research On The Chinese And Russian Anti-terrorism Legislation

The terrorism crime have already become the worldwide threat, in order to prevent and control the terrorism crime effectively , various countries strengthened fundamental research and the practice in anti-terrorism legislation. Under the vision of the international law ,there have been already many international joint pledges and the regional treaty related anti-terrorist at present,and China and Russia participate in majority of them.Under the vision of national law,various countries are devoting in the construction of their own anti-terrorist legislation ,but the patterns of Chinese and Russian anti-terrorist legislation are obviously different.China and Russia are the neighboring countries, and both are neighbors of the central Asian nation,so they face the terrorism threat which have many centers of similitude, thus, the Chinese and Russian anti-terrorist experience exchanges will be the most valueable model.Russia is one of the countries which are threated by the terrorism most seriously,so it takes the construction and the consummation of the anti-terrorist legislation seriously,and has formed its own style of anti-terrorist legislation.Not only it has stipulated terrorist crime recognizing in the federation criminal law with the punishment, but also formulated special "Russian federation Anti-Terrorism Law".The Lhasa beating, smashing and looting event that occurs On March 14, 2008 even more showed that, terrorism activities in China were still rampant,not allowed to neglect. At present, Chinese anti-terrorist legislation limits merely to the penal code and the bill for amendment related stipulation, but does not have one technicality legislation like "Russian federation Anti-Terrorism Law" .In China,only some criminal laws were stipulated and they also have many insufficiencies compared with the Russian penal code. Moreover,as to how to connect the anti-terrorist legislation with national law and the international law, China and Russia also manifests the disparity. Through the comparison between China and Russia, the Chinese anti-terrorism legislation still need to comsumate diligently, we might consider to profit from the Russian anti-terrorism legislation,to perfect penal code on the terrorism crime and attempt to formulate one technicality legislation like"Russian federation Counter-Terrorism Law".Simultaneously,we also had to profit from the Russian anti-terrorism legislation on the experience in connection with national law and the international law.
