Labor relations is the basic economic relations,its social production and life is at the core position.As China's socialist market economy and the deepening of structural reform,the nature of labor relations for the contract status changes,labor relations and gradually establish a coordination mechanism,continue to improve labor laws and regulations.Stable and harmonious labor relations for high-speed China's economic and social development provides an important safeguard.However,in labor relations are fully aware of the tremendous progress achieved in the area at the same time,we should also see that China's socialist market economy with the deepening of reform,China's labor contract system has not been very good development,the number of labor dispute cases increased year by year,of labor-management conflicts are increasingly becoming the focus of social conflicts.The labor market in China is still a missing market.And 1 January,2008 will come into effect the "People's Republic of China Labor Contract Law" in the labor contract entered into,carry out, such as lifting and termination to make a more detailed provisions,the requirements of employers than the previous implementation of much more stringent labor laws and regulations,which in the community also had a different understanding and evaluation.In this paper,contract theory from the relevant analytical framework,combined with the actual situation of China's labor relations,labor contracts on their own nature,characteristics and management of labor relations and compliance mechanisms for a detailed analysis,and on this basis, analysis of the "Labor Contract Law," the thrust of the legislative purpose and content of the impact of labor relations and the role of stability in order to make an objective assessment of its.Strive for our enterprises to establish effective and harmonious labor relations in accordance with the provision of reference.
