Study On Alteration Mode Of Ship’s Ownership

As for the understanding of the alteration mode of ship’s ownership, there have always been many arguments, such as problems regarding the requirement of validity, meaning of anti-third party and the announcement and public confidence of ship registration. The<Judicial Interpretation of Sales Contract> enacted by the Supreme Court has some active effects in solving the existing issues, but the problems caused by it may lead to more chaos. In this article I have stated my understanding for this question, and put forward some suggestions.The first chapter is the overview of third alteration modes of ship’s ownership, introducing the connotation and the announcement and public confidence, in order to have a better understanding of our mode.In the second chapter, through analyzing the stipulations of alteration mode of ship’s ownership, the understanding of courts and academia with regard to this question, I summarized some issues needed to be further discussed, namely problems regarding the requirement of validity, meaning of anti-third party and the announcement and public confidence of ship registration.The third chapter is about the understanding of the alteration mode of ship’s ownership from should right angle. And draw the conclusion that delivery is the requirement of validity of alteration of ship’s ownership; ship’s registration is the anti-requirement and it has the effect of announcement and public confidence.The fourth chapter is about the evaluation and analysis of the<Judicial Interpretation of Sales Contract> enacted by the Supreme Court. And put forward some suggestions on the revise of it.
