Study On Legal Issues Of Ship Financial Leasing Registration

Shipping industry is a capital intensive industry.As a way combining finance funds and assets,ship financial leasing has become one of the most important financing methods for shipping companies because of its special advantages compared with traditional fund collecting ways,which is an effective way to alleviate shipping enterprises' financing difficulties.Ship financial leasing is regulated both by contract law and maritime law,Especially in the field of ship financial leasing registration,vessel differs a lot with normal movable property in public notice methods.Therefore,it is necessary to analyze the transaction mode and nature of ship financial leasing,to explore a suitable ship financial leasing registration pattern,to improve the existing laws and regulations in this field.The thesis is divided into three parts,which are introduction,main body and conclusion.The main body is consist of five chapters:The first chapter is introduction of ship financial leasing registration.This chapter mainly introduce the concept of registration,confirming that the registration discussed in thesis is in fact the bareboat charter registration in practice.The second chapter is the current situation of ship financing leasing registration in China.This chapter is consist of the legislative circumstances and practice,summarizing the legislative problems.The third chapter is choice of registration mode.This chapter is mainly making a research on three kinds of popular registration mode and compared with Chinese law and practice.The forth chapter is the effect of ship financial leasing registration.It focuses on the effective time,requirements and the range it can be against.The fifth chapter is about the advices to improve the current legislation.Based on questions appeared in the above four chapters,I give the long term and temporary method to solve those problems,hoping to give some reference to the improvement of legislation of ship financing leasing registration.
