The Promotion Of The Spirit Of The Rule Of Law And The Practice Of The Rule Of Law In Contemporary China

"The spirit of the rule of law" is not a new vocabulary, but in China, because of the party's 17th major reports of the era, it has a new meaning. To seize the problem with great academic value and flavor of the times ,we can find a new and innovative theory of incision for the further development of jurisprudence to provide the reconstruction and the innovation of the legal system with the power of the spirit in line with the trend of the times and the world. It is in this sense, I look forward to starting with the semantic analysis, targeted analysis, nurturing and enhancing analysis of the spirit of the rule of law, in order to describe the time and space factors and exploring and using the native resources in the course when we promote the spirit of the rule of law in our country which shoude be taken into account. By reviewing the achievements in the construction of the rule of law of more than thirty years of reform and opening-up and the sixtieth anniversary of the establishment of new China, to reveal the great changes of the spirit of the rule of law in the process, in order to broaden our vision of the rule of law, it will provide us with new theoretical resources and ultimately put forward the internalization of the people's consciousness of the rule of law. Therefore, we can make the necessary preparations for the full implementation of the realization of the spirit of the rule of law in the theory."The spirit of the rule of law"is an organic synthesis which integrates the spirit of good governance,the spirit of democracy, the spirit of human rights,the spirit of fair, the spirit of rationality and the spirit of harmonious. The Chinese nation is not natural to have a modern spirit of the rule of law and the spirit of the rule of law penetrating into the spirit of our nation can not be achieved in one day, China's road to nurture the spirit of the rule of law is not a natural process in historical development. The government-led constructivist-oriented line is taken in the development of China's rule of law by the government. The spread of the modern spirit of the rule of law depends on the advance of the government, the understanding and the master of the leaders and the leader's team as well as the self-recognition of people to the situation of Chinese society and the spirit of the rule of law. The process of the cultivation and the promotion of the spirit of the rule of law is a process in which the spirit of the rule of law penetrates into the spirit of our nation to achieve the self-reliance of the rule of law of the Chinese nation. In this process, we need to gradually change from the government-led constructivist-oriented model to a compound model of the development of the rule of law ,which involves the participation and the interaction between the government and the people, and takes the cultivation of the spirit of the rule of law of Chinese nation as a core, in order to achieve the objective of social autonomy.
