Timeshare hotel is an new investment product in commercial property market, which separates ownership from managerial authority.The developer divide the hotel into several independent parts,and sell them to the investors.Each investor enjoys independent ownership.And then the investors entrust a hotel management company with the management right.The investors can get a period of free occupancy besides the bonus.The problems which timeshare hotel confronts with in China are as follow:First of all,the orientation of the building land-use right is unclear.Secondly,divide the the whole hotel into several independent ownership is forbidden.Third,it is hard for the investors to get the certificate of title.Finally,the promises of fixed mercantile rate of return which made by the developer is forbidden.There are many investment risks at present.The crux of the problem is not the investment mistakes but the timeshare is still a new thing in China.Our country has not yet introduced laws and regulations on it.Investors can't make their own investment choices in a open and fair environment.Market risk can't be burdened fairly and reasonably between the parties.As a result,improving the legal system for timeshare from the angle of protecting the interests of investors,is suggested in this paper.
