The protection of laborers' rights and interests, to some extent, is a permanent topic and has existed since industrial relations came into being. However, in different ages, the protection of laborers' rights and interests emphasize on different aspects and include different connotations; meanwhile, in different ages, the pattern of the protection of laborers' rights and interests should change in accordance with the new change of the connotation of the protection of laborers' rights and interests and the new requirements of balancing capital rights and the protection of laborers' rights and interests. In the age of flexibility, the protection of laborers' rights and interests should give priority to realizing the protection of laborers' right to employment, or being able to promote laborers' full employment. The most effective protection of laborers in essence derives from the laborers themselves and the realization of laborers' rights to full empolyment. Therefore, the system and design of the protection of laborers' any right and interest should first guarantee the realization of laborers' right to full employment. However, at present, the realization of laborers' right to employment, or the realization of laborers' full employment, to a large extent, depends on the flexibilty of labor market. Therefore, in the present society, the core issue relating to the protection of the laborers' rights and interests is in fact the problem of balancing flexibilty and security of labor market; or in other words, the core issue is how to realize flexibility and security of labor market in the process of labor market flexibility and how to realize decent employment in the age of flexibility to strengthen social cohesion and promote social inherence. Taking this as the background, the paper first studies the harm that labor market flexibility does to the rights and interests of laborers and the challenge that the traditional way to the protection of laborers' rights and interests faces; secondly, the paper analyzes the new exploration that western countries conduct to balance labor market flexibility and the protection of laborers' rights and interests in the age of flexibility from the perspective of international comparative study; finally, integrated with our country's concrete conditions and learning the experience of the western countries, the choice of the protection of laborers' rights and interests model in the age of flexibility in our country is put forward. The whole article is divided into five sections:Section one, the erosion that labor market flexibility does to laborers' rights and interests. Labor market flexibility is not only a multi-dimensional concept, including various forms; it has also become the pursuit and the guide to policies of the labor market reform in western countries. The reform of labor market flexibility involves many aspects, and correspondingly, the erosion that labor market flexibility does to laborers' rights and interests is also mulriple. Specifically, the erosion includes the increase of unstable employment, weakening of the organization of the protection of laborers' rights and interests, expanding of laborers' income gap, the increase of "working poor", labor marginalization and intensifying of social exclusion.Section two, the new connotation of the protection of laborers' rights and interests in the age of flexibility. In the age of flexibility, aiming at the above erosion that labor market flexibility does to laborers' rights and interests and the new change of laborers' requirement of their rights and interests, the connotation of the protection of laborers' rights and interests has far beyond the traditional and single category of striving for higher income, shortening working hours and improving working conditions, thus conforming to the times and having the characteristic of extensiveness. Specifically, the new connotation of the protection of laborers' rights and interests in the age of flexibility can be summarized as follows: the decent job at the level of labor standard, security at the level of labor market and social inherence at the social level.Section three, the challenge that the traditional pattern of the protection of laborers' rights and interests face in the age of flexibility. In the western literature, the pattern of the protection of laborers' rights and interests is divided into employment protection, legislation protection and social protection. In the age of flexibility, the traditional protective pattern of the protection of laborers' rights and interests is facing serious challenge. Specifically, that is the unfairness and inefficiency of employment protection and legislation protection and insufficiency of social protection.Section four, the new exploration of the protective pattern of foreign laborers' rights and interests in the age of flexibility. The successful or creative pattern is mainly as follows: "Golden triangle" social protective pattern in Denmark, new employment protection and legislation protection in Sweden and new employment contract protection in Spain. The common characteristic of three patterns is trying to combine labor market flexibility and the protection of laborers' rights and interests. Their difference lies in that the above countries adopt different manners in the combination or balance according to their respective historical and cultural traditions and political feasibility.Section five, the choice of the protective pattern of laborers' rights and interests in our country in the age of flexibility. In this section, current controversy of the relationship between labor market flexibility and the protection of laborers' rights and interests in our country is analyzed. Secondly, integrated with our country's concrete conditions and learning the experience of the western countries, the pattern choice of the protection of laborers' rights and interests in the age of flexibility in our country is emphasized. Specifically, it is to realize three transformation: transformation from job security protection to employment security protection, transformation from employment protection and legislation protection to the protection of collective bargaining system, and transformation from social protection to employability protection.
