Construction Of Special Legislation Protection Model Of Folklore

As an important part of national culture assets,folklore is also an important part of human civilization.Since 1950's,folklore has been suggested to be protected by some countries and international organizations.With the technological revolution,folklore becomes more and more important in international economic association,so it has been gradually realized,but there is no complete international model of its protection.Our country has lots of nations,vast territory and abundant resources.Facing the crisis of inappropriate utilization,being distorted,being on verge of extinction,our country has taken measures and issued relevant laws,but there is no perfect protection model, which is far away from the goal of protecting and bringing honor to folklore.Moreover,the lack of inheritor and unbalance of benefit-sharing have restricted the development of folklore,but there is no unified solving mechanism of benefit-sharing.After discussing and analyzing kinds of legislative practice,the thesis puts forward that we should adopting special legislation protection model basing on our country's real situation and overall needs of folklore.In order to promoting effective utilization and development of folklore,we also should put emphasis on solving lack of inheritor and unbalance of benefit-sharing.
