The Research To Make Associational Autonomy In Rule Of Law

With the social development, a large number of self-governing professional associations appear in china, such as the bar association, the football association, institute of certified public accountants. These organizations play an important role in different areas of the community. As self-governing organizations, these trade associations have broad autonomy to self-manage the industry, and they carry a certain social functions. As the current law lack of the provisions on the associational autonomy, it results in many legal issues caused by the self-management acts, so we should make the associational autonomy in rule of law. This article analyzes the legal nature, the scope, the power source and the content of the associational autonomy. And then I explore the necessity to regulate the associational autonomy, and the current legal provisions about associational autonomy. Then I try to improve and perfect the legal systems on associational autonomy, such as establishing the"law of industry association", and building the judicial review mechanism.
