Research On Autonomy For Trade Association From Legal Perspective

At present, a large number of trade association with autonomous attributes has emerged, the right of autonomy with the legally valid motion, which has become an important measure indicator of building a country under the rule of law in our country, mature market economy system and realizing social autonomy. As the middle of a social power, trade asso’ ciation plays an important social function in terms of promoting the autonomy and social self-discipline through the exercise of autonomy. Therefore, the aspiration for concern and research of state and all sectors of society grow with each passing day: the<Trade Association Law> has been included in the legislative plan of the National People’s Congress, the Legislative Affairs Office of the State Council started drafting in December2009; In November2013, President Hu clearly pointed out on the18th Party Congress that the important work of the coming period was to strengthen social management and innovation Legislative plan and policy guidance, provide the available practical basis and direction for the cultivating development and theoretical research of trade association.As the fundamental guarantee to autonomy of trade association, autonomy is an inexhaustible source of their own development:it is not only an important power, but also the basis for displaying autonomous function.But in practice, due to the lack of law in the autonomy of trade association, the limitations of the current management system as well as their own lack, sustainable development of the trade association and effective exertion of autonomy faced many obstacles. Therefore, research on the problem of the trade association autonomy, has become the necessary way to innovate social management, promote democracy rule of law, as well as realize the foundation of harmonious society.This paper starts with basic theory of the trade association autonomy, which reveals the rule of law and autonomy linkages based on value analysis; in reference to learning the realization of the domestic and foreign trade association autonomy, analysis of the current situation and constraints exercised by the trade association of China autonomy; finally, try to improve the government’s macro-oriented, trade associations based practice and the interaction between the supervisor about, in order to put forward the feasible path to exploration for the implementation of building and optimizing the autonomy of the Trade Association of China.Not only does the trade association autonomy have an important power for the social organization, but also has an important value and lasting significance for the promotion of an innovative society, the economic function-oriented government as well as the construction of a harmonious society and development. Therefore, guarantee the autonomy of trade associations fully and establish the autonomy of the trade association in the modern spirit of the rule of law, can not only promote the formation of the Social Administration of the legal system, but also contribute to the process of Social Administration and the rule of law in China.
