Study On Prevailing Mediation

With three decades of reform and opening up,China has transformed from planned economy to market economy,reaching the so-called period of social transformation.In this transitional period,all kinds of contradictions have occurred and thus lead to litigation explosion,indicating people's trust on the courts and the law,and desire for justice and fair.However,due to imperfections of legal system,corruption of power and lack of independence of the courts,judicial corruption is inevitable,which is followed by wave of letter-appeal and mass incidents,etc.In order to keep harmony and stability,and to resolve conflicts,mediation is emphasized by an unprecedented attention,forming a so-called prevailing mediation pattern while questions or reflections are rarely seen and in the published articles.Based on study of the history of mediation and analysis of background of the mediation and its mode of operation,as well as the drawbacks and the hazards in its actual implementation,in the sure after mediation analysis of the reasonableness of how to standardize the big goal of the rule of law mediation.
