Reflection On The Prevailing Mediation

With the foundation of the socialist market economy system, we have now come to an society-transition era in which disputes are characterized by its diversity and complexity. Also, the traditional means of mediation is now facing kinds of difficulties, nearly could hardly complete the mission of solving disputes, and, its influence on solving is declining. In order to make it better, our country, which is famous for its people’s mediation in problem settling, desperately need a new way of resolving all the contradictions.Based on the study of the "Prevailing mediation"(analysis of its background and mode of operation, as well as its merits in its actual implementation), Author of this paper makes a reflection of the "Prevailing mediation" from the point of "Mediation of the court". This paper is mainly made up by four parts. Firstly, I make a briefly introduction of the "Prevailing mediation" and its theoretical basis. Secondly, by describing the means of the "Prevailing mediation", then I make an analysis of its four characteristics. The third part is a serious thought base on the above description. The last part is a way on how to standardize the "Prevailing mediation" for the big goal of the rule of law.
