| At present, the subject with other tort defense system, the Defense system against news tort of China remains in the initial stage. With the reality of the rapid growth of China's news tort lawsuits does not match the infringement proceedings, only some of the more general judicial interpretation, and poor interoperability. For news infringement cases, the media often do badly battered, struggling to cope with. The long run, the situation will be strike the news media which is the important force of supervision by public opinion and will affect function of news media. Therefore, strengthen the study of the defense system against news tort is a matter of paramount importance. This paper focused on the study of news tort and its counterplea. On the basis of the interdictions and analysis of the news tort and counterplea overseas, this thesis discussed the situation of the news tort and its counterplea in our country from the aspects of both legislation and jurisdiction and some suggestion is given to improve the counterpleas of the news tort in China.
