The Study On Lawyer Culture Of China

Building a socialistic country ruled by law has become the clarion call of the time, the level of the development of the lawyer industry has become a recognized standard to measure the extent of a country and the lawyer culture, seen as the soft power of the lawyer industry, has also become a decisive force between each other. The lawyer culture includes the history of the lawyer industry, shows its status and indicates the direction of its development. As a soft power, though intangible, invisible, it has never ceased to exert an imperceptible influence on the lawyer industry, considering that, this article studies the lawyer culture of China, and focuses on the main problems and ways to solve.This article is divided into five parts, including more than 50,000 words. The specific content of each part is as follows:Part I: Introduction. This section outlines the main research framework of this article, the background of the subject, the theoretical value and practical significance to study this issue, as well as the historical analysis and sociology analysis of law.Part II: an overview of the basic theory of lawyer culture. This section, first of all, starts from the concept of the culture, traces the evolution of the history of the semantic of the culture, and then naturally leads to legal and lawyer culture and discusses the intrinsic link between them, defining the scope of this paper. Then, introduces the four parts of the lawyer culture; subsequently, the characteristics of lawyer culture are described in this article. On the flip side, this paper comprehensively analyzes the primary, advanced and last function of the lawyer culture. Finally, this article also explores the ancient Greece, where the lawyer industry begins, in accordance with the above, explains the social infrastructure of existence and development of the lawyer culture on the basic economic development, democracy and rule of law and socio-cultural environment. Now, the content above is the important part of the basic theory of lawyer culture.Part III: the development of the history of the lawyer culture of China. First of all, it traces the history of lawyer culture of China, pointing that the ancient China is white on lawyer culture, the lawyer culture so-called is imported from the West at the end of the Qing Dynasty, then, it had a very hard development from the old China to the new China. Then, this article discusses the basic characteristics and development situation of the lawyer culture of China. At last, it introduces the background of the time and the urgency and importance of strengthening the construction of the lawyer culture of China.Part IV: the main problems and responding measures in the current construction of the lawyer cultural of China. This section is the focus of the body. It is composed of five plates, followed by and discussing the relationship between the traditional culture and the lawyer culture, on the basis of redefining the traditional culture, analyzes the traditional culture's function to the lawyer culture, both positive and negative, pointing that the transformation of traditional culture should be put and ,and the lawyer culture should be popularized; at the same time, it also discusses the active function of today's mainstream culture in cultural construction, emphasizing the need to make use of mainstream culture to promote lawyer culture's development and construction; refutes the wrong perceptions ,such as ,"the lawyer are the embodiment of justice" and "the lawyer have always said good words for bad people", analyzes the lawyer's duty to amend the wrong position of lawyers in people's eyes at a high degree of theory and practice, pointing out that the lawyer is entrusted with the parties concerned to exercise their rights, should not be excessive and can not bear the responsibility of society; interprets the lawyer's commercial nature objectively and scientifically, systematically analyzes the lawyer's commercial nature in the traditional opinion, pointing out that on the basis of taking good consideration about it, we should take measures to limit and gives two practical operations for balance: Legal Aid and Politics. At last reveals that law firm is the birthplace of the lawyer culture, the cultural management is important to law firm, law firm's extension essentially is the battle and counter-balancing between different lawyer's culture, the article also points out that the lawyer's cultural construction should take care of the relationship between the team spirit and the personal style in order to make them moderate.The last part is the conclusion. This part summarizes the main views. Besides that, this paper also concludes that the construction of the lawyer culture has become an irreversible historical trend, an essence of the development of law firm; the key competitive soft power between law firms. Both the development of lawyer industry and the promotion of the rule of law are dependent on lawyer cultural. So, the study on lawyer culture and practice has become an urgent and important issue that can not be evaded.
