The Perfect Of The Urban Resettlement System On The Scope Of The Property Law Of China

As far as the modern China, the urban resettlement has become a hot issue during the process of modernization. How to establish and improve the compensation system of the urban resettlement is a socially concerned topic. Because it is directly related in the vital interests of resettles, in the protection of the private property right, in the social stability and achievement of the public interest, and even in the establishment of the harmonious society. This thesis tries to find various ways to solve the problem from the analysis of the well-known case of a holdout in Chongqing city.Besides the introduction and conclusion, this thesis concludes five parts. The part one briefly introduces the case of a holdout in Chongqing city. The part two introduces many opinions during the process of the case. The part three analyzes the problems during our urban resettlement system. The part four elaborates the enactment of the Property Law of China impact on the urban resettlement system. The part five provides the personal suggestions on how to improve the urban resettlement system of our country. Firstly, we should ensure the urban resettlement for the public interest. Secondly, we should define the content and scope of the resettlement compensation. Thirdly, we should clear the standards and methods of the resettlement compensation. Fourthly, we should improve the procedures and remedies of the resettlement compensation.
