The persistence in sustainable development is theonly way to solve the conflict between economic benefit and environment problems.Environmental impact assessment is an important environment prevention regulationto guarantee the legitimacy of environmental resource development by governmentand prevent potential environmental risks through legal procedure. Publicparticipation is the soul of environmental impact assessment and important indicatorto measure its democracy and scientificity. However, the system of participation isstill immature and even far from affecting the assessment system, and practical effectis far different from the expectation of legislation.This study will start from practical effect according to current laws and legalregulations to discover the defect in legal mechanism of public participation inenvironmental impact assessment, aiming to improve related legal mechanismsthrough the analysis in the levels of practice, procedure, system design and legalguarantee. |
