The Research About Perfecting The Hearing System Of Environmental Impact Assessment

In October2002, China promulgated the "Environmental Impact Assessment Law," in which the environmental impact assessment made specific provisions,"Environmental impact assessment refers to the planning and implementation of construction projects the likely environmental impact analysis, forecasting and assessment, to prevent or mitigate adverse environmental impacts of policies and measures for tracking and monitoring methods and systems."Environmental rights of citizens based on theory, theory of public property, public commissioned by the theory, stakeholder theory and democratic theory, public participation in environmental protection of the rights. Improve the environmental impact assessment hearing system is not only important to protect the public right of way protection is to ensure that the executive power to be fair, open and fair exercise of the important way to ensure fair, proper environmental management to achieve the necessary means. However, our environmental laws and regulations related to the provisions of this part is still too principle, operability is not strong. This environmental impact assessment system in the hearing as part of research objectives, mainly the following four aspects:The first part is the hearing system of environmental impact assessment of the general survey. The part of the author of environmental impact assessment of hearing concept, characteristics, classification, this paper discusses the principles, on the public participation in environmental protection concepts, theories and methods of environmental impact assessment system, demonstrates the establishment and perfection of the system of necessity. The second part is on the stage of the hearing system of environmental impact assessment. The part of the author mainly studies the United States, South Korea, Taiwan and other countries of the hearing system of environmental impact assessment of the relevant provisions, the next step for the research can provide a reference.The third part is our country hearing system of environmental impact assessment study. The author discussed our country hearing system of environmental impact assessment legislation, from four aspects has analyzed our country hearing system of environmental impact assessment of existing problems and shortcomings, for the fourth part of this paper provides the basis for writing.The fourth part is the focus of this paper, namely, how to improve China’s hearing system of environmental impact assessment. The author from the hearing on the representation is generated, the host system, the effectiveness of hearing transcripts, hearing form four aspects put forward their own perfection, thus the greatest degree of protection of the rights of public participation in environmental impact assessment.
