There are nearly 650 million disabled people in the world, because of their own shortcomings, they suffer social discrimination and exclusion, and are even deprived of their basic human rights. In order to improve the situation and protect their rights, on December 13, 2006, 61st session of the United Nations General Assembly passed "the Convention on the Rights of Persons with disabilities"(hereinafter referred to as "the Convention"). China has 82.96 million disabled people. the Chinese Government has always attached great importance to improve the situation of persons with disabilities and the protection of the interests of persons with disabilities to participate actively in the formulation of the Convention, and on March 30, 2007, China soon signed the Convention. On May 3, 2008, the Convention entered into force, and it will promote the protection of the rights of persons with disabilities and people by legislative reform.At present, China has the legal system to comprehensively protect the rights of persons with disabilities and to promote the development of persons with disabilities. The legal system is formed by Constitution, Criminal, Civil and Administrative Law, Protection of Disabled Persons Act, Education Ordinance of persons with disabilities, employment regulations as well as the supplement of local laws and regulations to assist and support the disabled. After accession to the Convention, China positively takes the obligation and amends protection of Disabled Persons Act to achieve a better convergence with the Convention. But there is the gap with certain requirements of the Convention and the relevant law in China should be changed and improved. Although China has a relatively complete legal system of protecting disabled people, there are also a number of shortcomings. So we need to further improve the relevant laws and regulations specifically for disabled people, to develop legally binding standards for a unified disability, to develop rehabilitation, barrier-free, opposing the disability discrimination special laws and regulations, safeguard the rights of disabled people on the national legislation level.
