A Study On The Right Guarantee Of Persons With Disabilities In China—under The Perspective Of The Convention On The Rights Of Persons With Disabilities

With the development of society, people pay more and more attention to thedisabled, especially after the birth of the convention on the rights of persons withdisabilities, the international community has paid attention to this disadvantagedgroup. This article is based on the perspective of the convention to make a study onthe disability rights guarantee problem in China.This article includes four parts.The first part is the overview of protection of the rights for the disabled. First, anunavoidable question which the concept for the disabled was discussed then itsummed up three typical kinds of right protection mode for people with disabilities,the mode of human rights protection is the most advanced mode which advocated bythe convention, it highlighted the advancement of the convention on the legislativeideas. Again, it simply summarized the guarantee of rights of persons with disabilitieson the international law before the convention. It is emphatically for the necessity ofthe convention.The second part is the parsing of the convention on the rights of persons withdisabilities. This part emphatically from the convention of value concept,characteristics, principles, obligations of the state, and so on to explain the specialprotection of the rights for the disabled and provide the basis for our country toreference in the next part.The third part is our country present situation and main problems of theprotection of the rights for the disabled. Firstly, from the implementation of legalsystem and legal protection of the rights protection, it outlines the status quo of theprotection of the rights for the disabled in our country. Second, through thecomparison with the convention, it summarized the main problems of protection ofthe rights for the disabled in legislation and implementation of our country.The fourth part is the reference to the perfection of the convention. It gives many Suggestions from the legislative concept, perfecting the legislation system and otheraspects of the proposal by the provisions of the convention. For example, to introducethe advanced concept of human rights, modify the protection of disabled persons,draw up some other matched laws and regulations, play a positive guidance role ofdisabled persons’ federation and so on. Hoping to promote the protection of disabledpersons dedicate career better and faster development.
