The Prosecution Of Crime Prevention Duties Specialized Research

To value and strengthen the prevention of duty crime is to carry out the Party's strategy of anti-corruption as 'looking into its root causes and symptoms, comprehensive treatment, punishment and prevention, and paying attention to prevention', to implement the job demands of 'paying more attention to the causal treatment, to the prevention and to the system construction' put forward by 17th party congress, and to firmly push forward the important measure of the punishment and prevention corruption system construction. The prevention of duty crime is a socialization system engineering which is needed joint effort of all society. As the legal supervision organ, the procuratorial organ is based on the function of legal supervision to developing job, bearing peculiar characteristics and advantages, which is the important link for the punishment and prevention of corruption system construction. Because of its particularity function of legal supervision function, the procuratorial organ is determined to choose the way of specialization to exert its function for the prevention of duty crime, which is the explicit direction of the national procuratorial organ's 2nd conference on the prevention of duty crime. Therefore, it is necessary to strengthen the study on the prevention of duty crime for the procuratorial organ.This paper combines years of my procuratorial working practices, comprehensively uses criminology and criminal jurisprudence and procuratorial theory, etc, and is divided into three parts to discuss and study the prevention of duty crime. On the basis of the descriptions of duty crime and its prevention, the first section discusses the meaning and feature of the procuratorial organ's specialization in the prevention of duty crime. The 2nd section discussed the basic theory, the realistic basis and the value function of the procuratorial organ's specialization in the prevention of duty crime. The 3rd section combines the existing problem, uses the overseas experiences for reference, and presents the concrete idea of the procuratorial organ's specialization in the prevention of duty crime. This paper makes a study on the procuratorial organ's specialization in the prevention of duty crime, providing useful references to push forward the construction of the anti-corruption system.
