With the application of the Internet in daily life and popularization of the Alipay dominated Internet payment channels,people have gradually accepted the network transaction mode,and gradually become the main way for people to buy goods.In the mode of network transaction,the seller can provide consumers with more abundant goods at a lower price,and the range of consumers' choice is enlarged.But the current network transaction model is not due to the pink of perfection,the relevant legislation is not perfect in our country,government supervision,and consumers and sellers of information asymmetry and other reasons,resulting in consumer online trading mode is against the phenomenon of multiple,and consumer rights difficult situation.Vigorously develop the network trading model can not only provide convenience to people,the society and even the whole country has a very important significance.The Chinese government also put forward the development plan of "Internet plus",development of network transaction is conducive to China's economic development,is conducive to the promotion of enterprise development,help to promote people's entrepreneurship,increasing employment,maintaining social stability.However,there is no special law to regulate the legal system in our country.Specification of network transaction related legal norms contained in the "People's Republic of China consumer protection law","People's Republic of China product quality law","general principles of civil law","contract law","People's Republic of China People's Republic of China" in tort liability law.We should strengthen the norms of the network trading model,the protection of theconsumers in network trading mode,the first is to improve the relevant legislation,making the work of the norms of law.In order to explain the problem of "the protection of the rights and interests of consumers under the mode of network transaction",this paper is explained in the five chapter:The first part is about the concept and characteristics of consumer's rights and interests in the network transaction mode.By definition,the network transaction model status,characteristics and the network concept of consumer rights,and its difference with the ordinary consumers to carry on the analysis,clear terms,expansion and Countermeasures for the below the foundation.The second part is the current situation,problems and causes of the protection of the rights and interests of consumers under the mode of Internet trade.Through the analysis of the current legislation and the legal protection of China's current network trading model of consumer rights problems and reasons,to a comprehensive and systematic combing of relevant laws of China,proposed countermeasures to solve the following conditions.The third part is the current situation and experience of the legislation of the protection of consumer rights and interests in the foreign network transaction mode.Based on the current legislation on the issue of the United States,Japan,the United Nations,APEC and other countries and international organizations,consumers in the online trading mode to protect the rights and interests of analysis,summed up the perfect legal protection of consumer rights in network transactions in China under the mode of experience.The fourth part is the suggestion to improve the protection of consumer rights and interests in China's online transaction mode.Based on the foreign experience and the analysis of the present situation of our country,the author puts forward some suggestions on how to improve the legal protection of the rights and interests of consumers under the mode of Internet trade.The fifth part is the conclusion.
