Along with the development of computers and the network technology, Internet has been integrated into all aspects of social lives. It is no exaggeration to say that internet has become an indispensable part of daily life. When people enjoy the convenience that internet bringing, it create conditions for a kind of new crime—cyber crime. In recent years, the amount of cyber crime has rising. Cyber crimes make threat against the safety and order of internet. The phenomenon of cyber crime has attracted the attention of criminal academia. Many scholars research into the definition, categories, constitution and jurisdiction of cyber crime from various angles.This article analyses the constitution and jurisdiction of cyber crime mainly, based on the research achievements of other expert. The first part explores the definition of cyber crime, then analyses characteristics and categories of cyber crime. The second part analyses constitution of cyber crime at the base of traditional crime constitution theory. In addition, this part analyses conviction of some special cyber crimes. For example steal virtual property, cyber gambling and so on. The third part focuses on jurisdiction of cyber crime. This part analyses advantages and disadvantages of several jurisdiction theory about cyber crime and then point out the solution to resolve the problem.
