The right to know as a rational right was first given by Kent Copper in his speech in January 1945. Later, right to know movement was launched in the United States in the 20th century, so the right to know has been widely invoked and become an international and important concept. The Constitution in china amended in 2004 made it clear " the state respects and safeguards human rights". Later Government Information Disclosure Bill was promulgated to further protect the public's right to know. Because the protection of the right to know started late and there are some problems in the legal practice, it is worth to study. In this thesis, according to the case of Cheng Ma v . the government, I analyze the shortcomings of the opening of government information and the relief to protect the right to know, so I focus on how to solve these problems.The full text includes : introduction, body and conclusion.Partâ… : It is to present the case of Cheng Ma against government information, Introduce the right to know, privacy right, the scope of state secrets, discuss the relationship between rights and finally to find the balance among the three rights.Partâ…¡: It is to analyze the existing problems during the process of the opening government information and then find out the reasons of the Obstacles of the opening government information.Partâ…¢: It is to analyze the case to find out the problems of the protection of the right in existing law.Partâ…£: According to the case, it is to discuss the methods and principles of relief to the right to know in different countries and to give some constructive suggestions to reform and improve the right to know from these aspects: the ideas, systems building and institutional supervision.
