Research On The Emergency Legal System Of Public Emergency In XinJiang Region

Since the SARS incident, with the years of efforts of Chinese Government the public emergncies legal system has made great development. Chinese Government has esteblished the emergincy legal system which centered"The Law of the People's Republic of China on Emergency Responses". However , these laws which at national level may not be very suitable for religious and ethnic diversities of the Xinjiang Autonomous Region because of its macro, wide coveraged and its abstract. Therefore, it is very important to develope practical local laws and regulations, to improve legislation situation of current Region`s public emergency laws which could provide an effective legal protection for the public emergency in Autonomous Rerion based on the special character of Xinjiang.This article includs three parts. The first part briefly introduces the concept and charactristics of public emergency and focus on an analysis of the type of public emergency, characteristics and causes of Xinjiang Uygur autonomous Region. Accurate analyzing to the public emergency of Xinjiang will help to determine the connotation and extention of law system of public emergencies in Xinjiang. The second part discusses the general theory of the public emergency and status and the exsisting problem in Xinjiang ,focus on the definition and basis of the public emergency, and analyze the existing problems of the public emergency in Xinjiang systematically. The third part discusses the objectives, the key principales and specific countermeasures of legal system of the public emergency in Xinjiang. In this section, it is pointed that taking the public emergency into orbit of Ruling with Law has very important role in guaranting of maintaining national security and regional stability of Xinjiang, in resolving the crisis and in safeguarding the fundemental rights of citizens and alson in building of a harmonious society. This part emphasis the impotance of mading the local implementation of the law and regualtions of legal system of public emergency of improving the existing local legislation, of esteblishing scientific system of contingency plans and of perfeting relevant system in the Xinjiang Uygur Autonomous Region.
