Research On Public Subjectivity And Justifiability Of Justice

Public subjectivity and justifiability of justice are fundamental issues that both the establishment of democracy and ruling of law and the construction of harmonious society have to deal with. Public subjectivity is essential spirit of realization of self-value of public in modern democratic societies. It takes public participation as its form: public expresses its self-existence and being respect through individual participation; society embodies its validity and self-consistency of its system through individual participation as well. justifiability of justice is the essential requirement of eternal pursuit of human uppermost reason of judicial process and result.This paper interprets the realistic significance of realization of public subjectivity and justifiability of justice in a perspective of the relationship between subject and object, through which judicial practice are taken into account with applying relevant theories. Without public subjectivity, the subjective status in modern society would not be embodied and the value of justice in right-oriented society would not be realized. If the construction of a law-ruled society did not exhibits justifiability of justice, the practice would turn into nothing but a slogan, which would in turn barricade the proceedings of the area. As a result, it is a theoretical and practical issue urgent to be faced with that we have to make both into strong resultant force to promote the Socialist Construction Governed by Law by coordinating their relation and ensuring their balanced development. Justice is the last defense line of maintaining justification. So judicial process and result must embody its validity; and justifiability has to be expressed in some visible way, for which it cannot be realized without public participation.
