Fair Use Of Copyright System Under The Digital Information Age

Since the birth of "Anna Queen Act", fair use of copyright has been an important component in the theory of the copyright issue. This system typically reflects the copyright law to protect the copyright of authors and other interests and the promotion of the dual objective of the wide dissemination of information. But with the continuous development of science and technology, a digital information technology has been used more and more frequently in our lives, these technologies brought convenience to our daily lives, but it also brought unprecedented shocks and challenges to the traditional system of copyright. Face to these shocks and challenges, how fair use of the copyright system will be respond? In this paper, the purpose of writing this is that though the study of fair use of the copyright system to find the answer. The article is divided into the following four parts:First, do some research on the history, nature, and other basic issues of fair use. From a theoretical point of view to study fair use of copyright, understand its connotations of the concept, the development process of the system. Analyze three kinds of the theory of fair use which are existing in theoretical circle.The second part of the paper will research on the status of fair use of the copyright system under the digital information age. Discuss fair use should continue to be an analysis or not in the current era .I will use "Digital Library "and the" personal use " in network environment as these two typical examples to reveal the conflict between fair use of the traditional system of copyright and digital information age. Then, base on these to make an analysis and summary about the shortages of fair use in our copyright system status.The third part involves the fair use of the international copyright system changes and developments. Mainly from two angles: the theoretical development and legislative reform. Take the United States, the European Union and some international corporations as examples to reveal the current international attitude and approach on improving fair use system of copyright. Part IV is returning to the issue of China's legislative reform. Combine those analysis and research with China's national conditions to explore fair use of the copyright system development trends. Finally bring up some legislative suggestions to improve and perfect China's legal system of fair use of copyright. Reach to the purpose of writing this paper.
