On The Issues Of Space Right Of Property

With the development of modern industry, population expansion and the acceleration of urbanization, surface resources have decreased so quickly ,in the same time the desire of space resources is increasingly urgent. In late 19th and early 20th century, human use land from "plane" to "three-dimensional", so space right of property as the development of traditional property arises at the historic moment, it object are a certain range of space. Our country has first confirmed the right about land surface and underground in Property Law. As a new kind of property rights, space right has attracted attention in the academia. This article has studied begin with the basic theory and legislative of other country, and then discuss the law about space right in Property Law. At last put forward ideas to perfect the space right system of our country.This article divided into four parts. The first part introduces some basic theoretical, such as background, character and the concept of space right. These are the premise of establish space right system; The second part start with the introduction of foreign legislation, such as the USA, Germany, Japan, Switzerland, China's Taiwan, then comparative and analysis their different; The third part discuss the necessity of establish space right system from the perspective of value. After that this part analysis the legislation of our country especially analysis the law in Property Law; The fourth part puts forward some suggestions to build the space right system form the subject of right, the obtainment and elimination of right, the content of the right and the principle of exercising right, and improves it. It can guarantee the citizens' space right, and counterpoise the interests, and resolve conflict, and stable economical order.
