This article is going to study and research the origin and evolution of Humanistic by comparing it in the West, Ancient China and the human-centered ideas in Marxism. It aims to refine the modern scientific connotation of China. People-oriented as the key concept of scientific development, is the basic guiding ideology for constructing harmonious socialist society in the new period. As well, it is an inevitable choice and the ideology basis for the management of state affairs according to law, construction of a socialist country under rule of law and a society governed by law. For the establishment of the humanistic concept of legislation, we are required to use and show the spirit and ideas of humanistic during legislating, law enforcement and justice etc. Let the halo of humanity get through all the way of rule of law.First of all, the insistent on the humanistic concept of legislation requires the legislation to be human, in humanity and soaring humanistic spirit; and it should spurn legal instrumentalism and scrupulously abide by the standard of right in its work; it should improve and perfect the current law legislative system and program; it should try to realize the scientific legislation, democratic legislation and achieve people's rights in their utmost content. The legislation should do more to value human rights, pay more attention to the people's livelihood, and strengthen the security system for the disadvantaged groups to accelerate the social development further.Another, the implement of the humanistic concept of legislation require government to reflect the character of humanity, to make a government ruling by law, honest, responsible and sunlight; the government should try most to make its administration and enforcement of law to be humanistic. Finally, embodying the humanistic concept of legislation, the Justice revolution is a must to improve it to be independent and ensure justice to be fair practically with enhance of the public credibility.
