Marx's historical materialism views on human rights for China to realize development and protection of human rights as the core of the rule of law points out the direction and road-the first time since 1991, the Chinese government issued a White Paper on Human Rights to the 15 generals, the Communist Party to respect and protection of human rights identified as the main body of, from the 2004 "Human Rights" is in the Constitution to the "National Human Rights Action Plan (2009-2010)", reflects a human rights ideology of Marxism in contemporary China attach great importance. However, if the rule of law and human rights in contemporary China put Marx's vision of the practice, you'll see its shortcomings. In my opinion,on the one hand to Marx's conception of human rights anchored to redefine the subject of human rights in contemporary China; the other hand, in Marx's thought under the guidance of the human rights concept of reconstruction of the rule of law to achieve at the state and civil society, under the dual structure of interaction, in the substantive equality and procedural justice, the rule of law environment developed simultaneously cause of human rights and prosperity.
