On The Legal Issues Of The Infrastructure In Chongqing

Recent years, our country accelerated'the infrastructure construction. Many conflicts were caused by the land expropriation in the infrastructure construction. In this paper, it is field with the investigation and analysis on the land expropriation in the infrastructure construction, in order to explore solutions to the practical problems in the infrastructure construction in Chongqing, propel the infrastructure construction and promote social harmony and stability.The paper consist of five parts, which are "Introduction to land expropriation system", "analysis of Chongqing's infrastructure land empirical", "disputes and resolve status in Chongqing's infrastructure", "legal Measures for consummating land expropriation in infrastructure construction in Chongqing" and "the conclusion'"Introduction to land expropriation system" briefly describes the land expropriation system and the country's basic theory of land expropriation in infrastructure, analysis the characteristics, legal relations of land expropriation system and the reason for chosen the country's infrastructure for object of study."Analysis of Chongqing's infrastructure land empirical" analysised the status, existing problems in the infrastructure construction in Chongqing for legislative, law enforcement, the judiciary reasons. Empirical analysis is used in this section according to the grass-roots people's courts work experience and field survey results of the writer in Chongqing City."Disputes and resolve status in Chongqing's infrastructure" described and analysised the status and characteristics in the land expropriation which is accepted in second-level court in Chongqing in recent years. It classified and compared the disputes type in the practical land expropriation in Chongqing's infrastructure and discussed the predicament and the resolution.In recent years, Chongqing's first two cases before the Court of the land expropriation and characteristics of the description and analysis of the Chongqing Municipal infrastructure practice in land disputes in the type of classification compared to explore the existing dispute resolution channels and facing predicament."Legal Measures for perfecting land expropriation in infrastructure construction in Chongqing" proposed the legal measures to accelerate the legislative, prevent and reduce disputes in the terms of system, perfect relief mechanism and facilitate the disputes to be solved timely by drawing on the experience of extraterritorial legislation"Conclusions" section summarizes the results achieved in this study.
