The Perfection And Legislation Of People's Supervisor System

The people's supervisor system is mainly established by procuratorial organs to supervise the handling process and result of duty crime cases, in response to the outside world for the question of "who supervise the supervisor". Pilot since 2003, the system has been implemented more than a decade, which becomes more and more mature after experience of multiple reforms and perfection. In practice, it has obtained certain achievements with official endorsement. However, through close observation of its implementation status, we can discover the crisis behind the applause. The objective problems, such as the deficient mechanism for selection and management of the people's supervisor, incomplete independence of the supervision, unreasonable scope and low efficiency of the supervision system and so on, lead to the failure to achieve the vision of top-level design. Only through reflections and review of these questions, new architecture of the people's supervisor system can be re-built. Based on a solid legal theory, we attempt to seek a legalized road which corresponds to the ordinary rules of legislation in order to make the people's supervisor system give play to its real supervising function.
