America is a state of legalization. The law of education is very complete especially for ensuring the rights of academic freedom about university teachers. In this situation, the educational case-law has exerted an effect on it. The Supreme Court has intervened in the legal cases of academic freedom since 1950s, so there was the national influence of case-law principles through judging some important cases. The manner of university teachers striving for the academic freedom rights has changed. In the 1960s and 1970s, the educational case-law extended the range of university teachers'academic freedom rights. Hence, the teachers could use this effective approach to protect their own lawful rights and interests. After the 1980s, the educational case-law increasingly responded to the new demands of university teachers'academic freedom rights. Therefore the America has developed constantly the legal guarantee of their academic freedom rights.This paper will explore the particular significant of the educational case-law effect on university teachers'academic freedom rights by the historical and juristical vision. At the end, the author will attempt to summarize the evaluation of the influence of the American educational case-law over the university teachers'academic freedom rights basing on the above statement. Another, the conclusion will bring forward the significance of indrafting American educational case-law for our country's teachers in protecting their own academic freedom rights.
